Over 100 organizations signed a letter insisting Congress let “class-wide” emergency scheduling of fentanyl and like substances expire early.
The 100+ signatures believe the ‘unscientific policies destroy communities, entrench racial disparities, and do nothing to reduce drug supply or demand.’
'Fear-based' Enforcement Causes 'Painful, Involuntary, and Often Unsafe Withdrawal'
The signers suggest ‘Lawmakers should instead support legislation grounded in public health and evidence-based approaches to illicit fentanyl-related overdose deaths.’ The ‘fear-based, enforcement-first response’ has led to heightened incarceration and causes individuals to experience ‘painful, involuntary, and often unsafe withdrawal.’
Class-Wide Scheduling Will Lead to Over-Criminalization
The dispute is that ‘Class-wide scheduling excises public health and science from drug control and will lead to over-criminalization. The expiration of class-wide scheduling is an opportunity for the Biden administration and Congress to make good on a commitment to end mandatory minimums and embrace a public health approach.’
Class-Wide Fentanyl Scheduling is Just As Bad As Severe 1980s Crack Cocaine Mandatory Minimums
The letter compares the class-wide emergency fentanyl scheduling to the ‘past missteps’ of severe mandatory minimums for crack cocaine in the 1980s, causing people of color to be ‘disproportionately incarcerated and sentenced to mandatory minimum sentences for small amounts of crack cocaine.’
